1. Scope

This Refund Policy governs the conditions, terms, and procedures under which refunds may be requested and processed for Consumers who purchase digital products or services through the PLAIDRY platform, accessible at plaidry.com.

HSU Holding LLC, the legal entity operating PLAIDRY, acts solely as a technology intermediary that facilitates the connection between Creators (sellers of digital products and services) and Consumers (purchasers). HSU Holding LLC does not produce, endorse, or guarantee the quality of any third-party digital content offered through the platform.

By completing a purchase on PLAIDRY, the Consumer acknowledges and agrees to the terms set forth in this Refund Policy. This policy forms an integral part of the platform's Terms of Service and should be read in conjunction with them.

2. Nature of Digital Products

Products and services offered through PLAIDRY are exclusively digital in nature. This includes, but is not limited to:

Due to the inherent nature of digital goods, all products and services are delivered immediately upon successful payment processing. Once digital content has been accessed, downloaded, or delivered, it cannot be "returned" in the traditional sense, as the Consumer has already received and consumed the product.

3. Waiver of Right of Withdrawal

In accordance with Article 16(m) of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and their acknowledgement that they thereby lose their right of withdrawal.

Before completing any purchase on PLAIDRY, the Consumer is required to provide express consent through a clear and unambiguous affirmative action (checkbox confirmation) acknowledging the following:

This consent is recorded and timestamped in PLAIDRY's systems as part of the transaction record. Without this express consent, the purchase cannot be completed.

4. Cases Where Refund IS Applicable

Notwithstanding the waiver of the right of withdrawal described in Section 3, PLAIDRY recognizes that certain circumstances may warrant a full or partial refund. The following cases constitute valid grounds for a refund request:

A refund may be granted when the digital product or service suffers from a serious technical defect that renders it substantially unusable or inaccessible. This includes:

6. Recurring Subscriptions

6.1 Auto-Renewal

Certain products on PLAIDRY are offered as recurring subscriptions (monthly, quarterly, annual, or other billing cycles). By subscribing, the Consumer authorizes PLAIDRY to charge the designated payment method automatically at the beginning of each billing cycle until the subscription is explicitly cancelled.

6.2 Cancellation

Consumers may cancel a recurring subscription at any time by contacting soporte@plaidry.com or through the account management tools provided on the PLAIDRY platform. Upon cancellation, the Consumer will retain access to the subscription content until the end of the current paid billing period. No further charges will be applied after cancellation takes effect.

6.3 No Partial Refunds

Cancellation of a recurring subscription does not entitle the Consumer to a pro-rata or partial refund for any unused portion of the current billing period. The Consumer has already received and had access to the digital service for the duration of the paid period.

6.4 Promotional or Minimum Commitment Subscriptions

Some subscriptions may include promotional pricing, discounted rates, or minimum commitment periods as a condition of the offer. Early cancellation of such subscriptions may be subject to additional terms, including but not limited to forfeiture of promotional pricing or billing for the remaining commitment period. These terms will be clearly disclosed to the Consumer before subscribing.

7. Claims Procedure

All approved refunds will be credited to the same payment method originally used for the purchase. PLAIDRY does not issue refunds via alternative payment methods, store credit, or cash equivalents unless required by applicable law or where the original payment method is no longer available.

8. Bank Chargebacks

PLAIDRY reserves the right to retain transaction records and evidence of digital delivery for a minimum period of 60 days following any purchase for the purpose of responding to chargeback disputes initiated by Consumers through their payment providers or financial institutions.

Consumers are strongly encouraged to contact PLAIDRY directly at soporte@plaidry.com before initiating a chargeback with their bank or payment provider. Filing a chargeback without first attempting to resolve the issue through PLAIDRY's claims procedure may be considered misuse of the chargeback process and may result in:

Note: Abuse of the chargeback process, including filing chargebacks for products that were delivered as described, constitutes a violation of PLAIDRY's Terms of Service and may be subject to legal action.

Nothing in this Refund Policy shall be construed as limiting or waiving any rights that Consumers may have under mandatory consumer protection legislation in their jurisdiction.
